On BBC Humberside this morning, Deal has been done with Kcom to allow Nexus to offer broadband to Hull Businesses

Looking at the website is £29.99 for up to 8mb down 0.5mb up.

Is it for Broadband or just telephony ?

Business only I am afraid - domestic users still won't get access to either !!!

At last the start of some competition - in the business market that is - doesnt do much for us residential folk though.

Also, doesn’t get round the fact that every KC line in Hull is illegal through “tying” under the competition Act where Ofcom should be regulating KC under its SMP oversight and that’s a fundamental problem in restricting consumer choice as the local calls market is somewhat "rigged" in KC's favour.

It’s not acceptable for KC to now to spin the headlines and say that “were open to competition now ” – For telephone lines that may be coming but for  telephone calls its another story - In either retail or wholesale calls markets there is no competition to KC for calls.

The Nexus deal, I understand, also involves taking KC for calls - how convenient for KC !   

The next battle is the “tying”  - making the purchase of a KC line conditional on the purchase of their local phone calls since if you do not agree to this to cannot purchase the line - Which is illegal  - Remember Microsoft and Internet Explorer !!!!!.

I believe at least one person is just about to take KC to the UK Court on this now as both Ofcom and KC have failed to and that communication between Ofcom and KCOM has now been exhausted by the person trying to purchase an "untied" line (Free of KC local calls) since you cannot purchase an "untied"  telephone line in the Hull area - BT would never have got away with it - and still couldnt if they tried ! 

I believe OFT may also investigate the “tying” under unfair contract terms legislation.

What would stop us taking up a business tariff? £30 is quite acceptable for 8mb 14:1 ratio anit it?

A spokeswoman for KC said the agreement was "definitely not" a deal to provide the west Yorkshire company with wholesale line rental rates.
Ok question who will you pay line rental to Huh? KCom or Nexus
If Kcom then retail volume deal, if nexus the CDR will be passed from Kcom to Nexus and Nexus will bill the customer.
That means that Nexus will be responsible for fraud on the service and as such this becomes a wholesale deal as the risk on the provision resides with the customers operator (Nexus)
Oh dear Kcom you should read you Ofcom guidelines !!!!!!
